Terms of service.

  1. THE DEPOSIT is non-refundable and needs to be paid in full in order to reserve the date. The agreed payment needs to be paid in full BEFORE the photo session/event. Once the payment is paid in full, the payment is NON-REFUNDABLE, unless I am unable to make the session due to a circumstance out of my control. Refunds are not available.

  2. TIME is valuable to both the client and the photographer. If the client is more than 20 minutes late to the session (without communication with the photographer) the photographer reserves the right to leave the photo session, while keeping the full deposit. 

  3. CANCELATIONS for whatever reason do not warrant a refund, however, it can be used as credit for future photo shoots. 

  4. TURN AROUND TIME: For weddings, expect 4-6 weeks to receive your photos. For all other sessions, allow 10-12 days to receive your photos. Sneak peeks will be available throughout that time.  

  5. IF PHOTOGRAPHER is unable to perform the services in this contract due to any cause outside of her control, client agrees to indemnify photographer for any loss damage or liability; however, photographer will return in full all payments made by client to photographer in relation to this shoot.

  6. CLIENT agrees to indemnify and hold the photographer harmless for any liability, damage, or loss related to technological failure, including data loss.

  7. CLIENT understands and agrees that the photographer is not required to maintain copies of the photos from this shoot 21 days after the photos have been delivered to the client.

  8. CLIENT agrees to not edit/alter the finished product- if they would like something changed, the client will speak with the photographer before altering the photo. 

  9. PHOTOGRAPHER will strive to present photos in a workmanlike manner but is not required to cater to specific aesthetic preferences of the client.

  10. CLIENT agrees that the PHOTOGRAPHER cannot control the weather. Sun, wind, rain, snow, & any other weather conditions can and most likely will affect the outcome of your photos (i.e. shadows, squinty eyes, flying hairs/clothing, etc.)  The photographer will do her best to make them look the best as possible, but it is not guaranteed due to situations out of her control.

  11. CLIENT agrees to not hold the PHOTOGRAPHER responsible with the way the client looks physically, what they chose to wear for their photo shoot, how they decided to wear their make-up and hair, etc. Photographer will do her best to capture the optimum angles, backgrounds, and poses to reflect body types in the best way.

  12. PHOTOGRAPHER and CLIENT agree that the photographer is under no obligation to capture any specific moment or pose or person(s) during the shoot.

  13. CLIENT agrees not to alter the edited pictures in any way or form. This includes: cropping, filters, etc. If the client wishes to change the picture, ask the photographer before doing so. 

  14. MODEL RELEASE: Client grants permission to the photographer and its assigns, licensees, and sub licensees, permission to use clientโ€™s image or likeness in any and all forms of media for commercial purposes, advertising, trade, personal use, or any and all other uses. Therefore, the photographer may use clientโ€™s likeness and image on photographerโ€™s website or other advertising.

  15. EXCLUSIVE PHOTOGRAPHER: Client agrees and understands that no other party other than photographer may take pictures of any poses, lighting situations, or setups made by the photographer. This slows down the photographerโ€™s work and violates the photographerโ€™s right to take pictures of the event. Client agrees to take responsibility for insisting that no person(s) get in the way of the photographer or take pictures in these situations.

  16. DUTY OF CLIENT:  Client will obtain all permissions necessary for the photographer to photograph at the shoot. Photographer has no duty to obtain permission of reception centers, churches, buildings, properties, or other locations to operate thereon. Client understands and agrees that any failure to obtain these permissions resulting in fines to photographer, or which prevent photographer from photographing the event(s) is not the fault, liability, or responsibility of photographer.

  17. TRAVEL REIMBURSEMENT: Client is responsible for all travel expenses. (i.e. flight, transportation, room and board for the photographer) After extensive research, the photographer will provide a flat rate for travel expenses. This is only if the photo session is located outside of Utah/Salt Lake County. The client is also responsible for park fees or venue fees if it is required.
